Structure:body:roof and pillars

BMW of North America, LLC (BMW) is recalling certain 2016-2019 X1 sDrive28i and X1 xDrive28i vehicles. In the event of a crash where the occupants head contacts the B-pillar, the pillar may not absorb an adequate amount of the impact. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard (FMVSS) number 201, "Occupant Protection in Interior Impact."

In the event of a crash, the insufficient impact absorption can increase the risk of injury.

BMW of North America, LLC (BMW) is recalling certain model year 2016-2017 X1 sDrive28i, X1 xDrive28i, MINI Hardtop 4 Door Cooper, Mini Hardtop 4 Door Cooper S, MINI Cooper Clubman, and Cooper S Clubman, 2017 Rolls-Royce Ghost, and 2016 528i vehicles. The vehicle-sensitive locking mechanism of the seat belt Emergency Locking Retractor (ELR) for the driver's seat may not lock as designed. As such, these vehicles fail to comply with the requirements of the Federal Motor Vehicle Safety Standard (FMVSS) number 209, "Seat Belt Assemblies."

In the event of a crash where heavy braking is applied, the Emergency Locking Retractor (ELR) may activate when the occupant is more forward in the seat, possibly increasing the risk of injury.

BMW SERVICE ADVISER SAID THIS IS A DESIGN ISSUE AND THERE IS NO AVAILABLE FIX. VEHICLE IS STATIONARY WHEN THIS OCCURS. I HAVE EXPERIENCED THIS AT LEAST SIX TIMES IN THE LAST FOUR MONTHS. SPONTANEOUS CLOSING IS PARTICULARLY DANGEROUS IF YOU ARE IN THE OPEN HATCH AREA AND THE HATCH STARTS TO COME DOWN ON YOU...

BMW HAS ISSUED TWO RECALLS RELATED TO MY 2017 BMW X1 FAILING TO CONFORM TO FEDERAL MOTOR VEHICLE SAFETY STANDARDS RELATED TO THE EMERGENCY LOCKING RETRACTOR (NO. 16V-747) AND TRIM PIECE (NO. 19V-349) - WITH NO REMEDY AVAILABLE AT THIS TIME. THESE RECALLS HAVE BEEN EFFECTIVE SINCE APRIL AND MAY 2019. AS OF JULY 2019, THERE IS STILL NO REMEDY AVAILABLE. BMW HAS FAILED TO REMEDY THIS DEFECT WITHIN A REASONABLE PERIOD OF TIME.

GLOBAL IMPORTS BMW (500 INTERSTATE N PKWY, ATLANTA, GA 30339, 770-951-1119) WAS UNABLE TO DETERMINE WHEN AN APPOINTMENT COULD BE SCHEDULED. THE MANUFACTURER WAS CONTACTED. THE CONTACT HAD NOT EXPERIENCED A FAILURE. VIN TOOL CONFIRMS PARTS NOT AVAILABLE.

THERE IS AN ACTIVE RECALL (RECALL # 19V349). HOWEVER NO SOLUTION IS IN PLACE AND I'M AT RISK DRIVING THE VEHICLE WITH REAR SEAT PASSENGERS (INCLUDING KIDS). THE RECALL CAME IN APRIL AND IT'S OCTOBER - WITH 6 MONTHS, NO SOLUTION HAS BEEN IDENTIFIED AND NOTHING IS DONE FROM BMW.
